Hon. Russell Bostrom settled a multi-party, catastrophic personal injury matter involving a 30 foot fall from an elevator shaft, wherein the plaintiff also had an elevated blood alcohol content. Issues contested were liability, damages, and coverage. After mediating all day and into the late hours of the night, the matter resolved for $8.5 million dollars. One attorney commented, “I would not hesitate putting any dispute before Judge Bostrom whether I was a plaintiff or a defendant. I have nothing but the utmost respect for him and think he is without a doubt the finest mediator I know!”

Hon. John Leo Wagner settled a controversial joint venture dispute between a multi-national corporation and a company owned by the world’s leading expert in volatile fluorine gas technology. Claimed damages exceeded $80 million dollars. Judge Wagner traveled across the country for the two sessions and was not only able to settle the matter, but was also able to rebuild the business relationship. Clients universally agree that Judge Wagner’s expertise in complex commercial litigation far exceeds their expectations. He not only understands the business intricacies, but appreciates the high stakes involved.

Jay Cordell Horton, Esq. was selected by the courts and the parties to serve as a mediator between 54 plaintiffs and The Regents of the University of California in the cases arising out of the failed UCI Liver Transplant Program. Allegations included medical negligence and misrepresentations by UCI as to the capacities of the program, which plaintiffs claim led to injury or death of patients then awaiting a transplant. The Regents have vigorously denied these allegations. Mr. Horton has successfully settled 42 out of 49 of the cases, despite the fact that they are all still in the pre-discovery stage. One attorney commented, “Jay Horton was able to quickly assimilate the medical knowledge in order to analyze each case on its individual merits. His work was clearly instrumental and resulted in multiple settlements of extremely complex matters!”

Janet Rubin Fields, Esq. settled a complex multi-party breach of contract case involving doctors & shareholders for purchase and sale of a surgical center. Allegations in the case included recission, fraud, and abuse of process. After ten months of tenacious negotiating, the matter resolved for well over six figures. One of the attorneys in the case had this to say, “Janet has a knack for listening to the clients concerns rather then dictating what she thinks should happen. She views the case not only from an economic standpoint, but also considers the emotional investment of each party.”

Jack Daniels, Esq. settled an emotional insurance bad faith case involving a fatal car accident in which coverage was denied due to the plaintiff’s premium being paid one day late. The attorneys were in trial when the Judge recommended they try to settle the dispute privately. Jack Daniels settled the matter after a full day session and rigorous follow up over the weekend for a confidential amount. One attorney commented, “Mr. Daniels was available to us 24 hours a day until settlement was reached. He was sensitive to the parties and the facts of this horrific case and was able to focus in on the liability and damage issues and move us towards resolution.”

Hon. James Jackman resolved a complex business matter involving 26 shareholders against a publicly held corporation. Causes of action included both individual and shareholder derivative claims, corporate mismanagement and dissolution, securities fraud and accounting irregularities. After several challenging mediation sessions and tireless efforts on the part of Judge Jackman, the matter settled for a confidential amount in the millions. Said one attorney in the case, “Judge Jackman is extremely knowledgable, sharp and skilled as a mediator....I would absolutely use him again on any case!”

Darrell Forgey, Esq. settled a complex multi-party catastrophic personal injury matter after intense mediation sessions for a confidential amount in excess of eight figures. The matter involved a minor who was seriously injured in-utero when the mother slipped at a retail chain store; resulting in the infant being born with severe cerebral palsy. Hotly debated issues included causation and the nature and extent of the lifetime economic damages. One attorney said of the experience, “In my 38 years of handling catastrophic cases, I have never seen a case less likely to survive the thicket of the settlement process, but Darrell kept it all together. He worked the phones relentlessly, and when things threatened to fall apart, he came up with an idea that allowed the process to live to see another day. Amidst swirling tensions and anxious moments, Darrell got it done. No one would have believed it.

Testimonials about Judicate West’s Client Services

“I appreciate that JW has gone the extra distance to find out as much about the case as possible in suggesting the right mediator. Also, I am amazed at how frequently both the plaintiff and defense are readily agreeable on using a neutral from JW.”
- A named partner in a firm and Board Member of the Association of Southern California Defense Counsel

“I wish to commend the hospitality and efficiency of the entire Judicate West staff during the handling of this matter. It was a very positive experience, and I am most satisfied having chosen your company to facilitate our Dispute Resolution needs.”
- Excerpt from a letter from a first time client

“During a mediation I had the opportunity to spend a substantial amount of time in the reception area of your office. I was so impressed by the client handling of the front desk administrator; I felt the need to comment in writing. The telephone manner was extremely courteous and they checked on me several times throughout my stay to see if I needed anything. I’ve managed offices in the past and have had more opportunities to wait in reception areas then I care to count. This was so unusual I found myself making mental notes as to why this was so different. I just wanted to pass on a very favorable impression.”
- Excerpt from a letter from the client of an attorney who was in an all day mediation

“Everyone at my firm was very pleased with the handling of this matter, we appreciated having a point person to go to and anytime I needed something done the response time was great. Everyone we dealt with was very friendly and professional.”
- Attorney at the Southern California office of a national law firm

“Hands down, the reasons I like Judicate West are because of the talented Panel of Neutrals, the reasonable fees, and the best service around!”

- Plaintiff attorney in Orange County who specializes in business and real estate litigation and used a newly retired Judge as Mediator in a complex case

It was always heard around our firm how we chose mediators and arbitrators, not providers; but now Judicate West has become the exception.  I routinely find our attorneys prefer Judicate West for recommendations for new top talent that ends up entrenched on our short list as a firm favorite.
